A proposal to extend China's minimum paid annual leave and strengthen enforcement of the two-day weekend system has sparked discussion online during the ongoing two sessions.

On Wednesday, the topic "the rule granting five days of annual leave for those with less than 10 years of service should be adjusted" trended on social media.

代表建議：落實(shí)雙休制、升級年休假

“當(dāng)前，我國勞動(dòng)人口存在‘沒假休’‘不能休’‘不敢休’的情況，這不僅影響群眾幸福感，也制約了消費(fèi)潛力的釋放�！�全國人大代表，浙江安吉余村黨支部書記、村委會(huì)主任汪玉成接受媒體采訪時(shí)表示。

“目前的年休假制度中，假期時(shí)限與工齡長短的銜接過于僵硬。”汪玉成指出，根據(jù)2008年頒布的《職工帶薪年休假條例》，職工累計(jì)工作已滿1年不滿10年的，年休假僅5天。

在我國人口結(jié)構(gòu)老齡化加劇的背景下，工齡10年以下的青年勞動(dòng)力正成為社會(huì)發(fā)展的中堅(jiān)力量，承受著較大的物質(zhì)和精神壓力，5天的法定年休假難以保障其充分休息。

He noted that the current system grants only five days of paid annual leave to employees with one to 10 years of cumulative work experience, which he said is insufficient for younger workers facing growing pressure.

他還表示，年休假制度對占旅游市場主體地位的青年群體也形成了消費(fèi)抑制。

針對上述問題，汪玉成建議嚴(yán)格落實(shí)現(xiàn)有工時(shí)規(guī)定，守護(hù)勞動(dòng)者“雙休權(quán)”。 對企事業(yè)單位工時(shí)執(zhí)行情況加強(qiáng)監(jiān)督管理，讓“雙休制”從紙面走向現(xiàn)實(shí)。

強(qiáng)制實(shí)施帶薪年休假，將落實(shí)帶薪年休假作為勞動(dòng)保障監(jiān)察的重點(diǎn)內(nèi)容，加大執(zhí)法檢查力度，并將企業(yè)落實(shí)情況與獎(jiǎng)懲、信用、等級評定掛鉤，激勵(lì)企業(yè)主動(dòng)履行義務(wù)。

同時(shí)，修改年休假天數(shù)規(guī)定，按工齡遞增讓青年“多休假”。

2026年全國兩會(huì)期間，全國人大代表、遼寧大學(xué)校長余淼杰提交了關(guān)于進(jìn)一步推進(jìn)節(jié)假日改革，釋放消費(fèi)潛力的建議。

建議將最低法定年假從5天提高到10天，并允許未休年假在兩年內(nèi)結(jié)轉(zhuǎn)使用，強(qiáng)化彈性休假能力，同時(shí)對年假使用率低的單位加強(qiáng)監(jiān)管。

Another deputy, Yu Miaojie, president of Liaoning University, suggested raising the minimum paid annual leave from five to 10 days and allowing unused leave to be carried over for up to two years.

《職工帶薪年休假條例》將修訂

今年年初，人社部在例行新聞發(fā)布會(huì)上表示將推動(dòng)修訂《職工帶薪年休假條例》，促進(jìn)用人單位落實(shí)該制度。

China's Ministry of Human Resources and Social Security said earlier this year it would push forward revisions to regulations on paid annual leave to improve implementation.

在我國，職工帶薪年休假的權(quán)利可以追溯到1994年頒布的勞動(dòng)法。2008年1月1日，《職工帶薪年休假條例》正式施行。同年發(fā)布的《企業(yè)職工帶薪年休假實(shí)施辦法》進(jìn)一步細(xì)化規(guī)則，至此形成相對完整的制度框架。

《職工帶薪年休假條例》規(guī)定：職工累計(jì)工作1到10年，年休假5天；10到20年，休10天；20年以上，休15天。因工作需要不能安排休假的，單位應(yīng)予以日工資收入300%的補(bǔ)償。

時(shí)隔18年，這項(xiàng)事關(guān)4.02億職工休息休假權(quán)的制度有望“上新”。

專家表示，查漏補(bǔ)缺、優(yōu)化供給、增強(qiáng)剛性或是此次條例修訂的核心議題，讓“想休不敢休”真正變成“應(yīng)休盡休”。不只是權(quán)利回歸，更是制度升級的關(guān)鍵。

China introduced paid annual leave in the national labor law in 1994, with the current regulation taking effect in 2008. Employees with one to 10 years of service receive five days of leave annually. After 18 years, the regulation affecting more than 400 million workers may be revised, with experts expecting stronger enforcement.

也有網(wǎng)友擔(dān)心落實(shí)情況，認(rèn)為應(yīng)該加大監(jiān)管力度。

Some online users have also expressed concerns about implementation and called for stronger supervision.
